How is hospital medical waste regulated in California? 

In California, biohazardous waste is regulated by the California Department of Public Health, Environmental Management Branch. Their regulations fall under the Medical Waste Management Act (MWMA), which applies specific regulations, based on whether the medical waste generator is a large quantity generator (producing over 200 lbs. per month of waste), or a small quantity generator (producing less than 200 lbs. per month of waste).

The act further dictates that:

  • If a small quantity generator generates more than 20 lbs. of biohazardous waste in a month, this waste (including sharps) must be stored above 32 degrees Fahrenheit at any onsite location for more than 7 days (unless written approval is provided by the department)
  • If a small quantity generator generates less than 20 lbs. of biohazardous waste per month, it cannot be stored onsite above 32 degrees Fahrenheit for more than 30 days


In addition to these stringent regulations, generators are required to maintain a comprehensive tracking document for all waste that has been removed, treated, transported or disposed of, for a period of 3 years.

Waste Classification

The waste must satisfy three criteria in order to be classified as medical waste:

  • The material must be a waste product.
  • The waste must be either biohazardous or sharps waste. Various forms of waste are defined as biohazardous because of the actual or presumed presence of pathogenic microorganisms, including laboratory waste and fluid blood. Objects which have been used in invasive procedures, such as hypodermic needles, and broken glass items contaminated with blood or other biohazardous waste are considered to be sharps waste.

Storage Requirements

California state requirements mandate:

  • Medical waste should be contained separately from other waste

  • Sharps waste must be contained in a sharps container

  • Red biohazard bags are to be placed in secure area for storage, handling, and transport
