South Dakota Biohazardous Waste Regulations


While there’s no shortage of things to see and do in South Dakota, there is a massive shortage of healthcare workers. The South Dakota Department of Health predicts thousands of additional healthcare workers will be needed in the near future. To address this issue the “South Dakota Healthcare Workforce Center” has been established and is designed to develop and implement programs to assist individuals, agencies and facilities in their efforts to boost this sector.

A growing healthcare industry produces medical and biohazardous waste, and in South Dakota the Department of Environment and Natural Resources and OSHA govern healthcare waste regulations. According to these regulations all medical waste must be stored appropriately and correctly labeled with “Infectious Waste,” “Medical Waste,” or the universal biohazard symbol, in a protected area using refrigeration where suitable to keep waste in a “non-putrescent ” state. All storage containers are required to be leak and moisture resistant, rigid and sealed during transport. Facilities are permitted to reuse containers as long as they have been disinfected and decontaminated. Waste treated off-site requires special permits for storage, transportation, and treatment.

All of our sharps and medical waste containers undergo a rigorous cleaning process by one of our ‘Washsmart’ tunnel washers, eliminating any BBP (blood borne pathogen) risk. Our 6-stage cleaning process combines a high-pressure cold flush, warm water washes and a hot final rinse with hospital-grade disinfectant to ensure ALL contamination is removed. Our robotic process enables hands-free, safe and thorough decontamination, which has been developed and tested to achieve a 6-Log reduction in microorganisms.

Our machines incorporate closed loop control systems for temperature and time with parametric release and monitored alarm systems that prevent a cycle from progressing if the cycle parameters are not attained. A visual inspection is carried out on all containers in conjunction with routine ATP swabbing and analysis to ensure our containers are cleaner than the acceptance criteria of the environments they are used in. Waste Classification

The Administrative Rules of South Dakota (ARSD) Section 74:27:07:01 adopt a medical/infectious waste definition found in the Code of Federal Regulations (40 CFR Part 60.51c). This lengthy definition broadly means any waste generated in the diagnosis, treatment, or immunization of human beings or animals, including related research, and production or testing of biologicals.  Regulated medical/infectious waste is most commonly generated in hospitals, clinics, dentist offices, and veterinary facilities.

Storage Requirements

South Dakota state requirements mandate:

Storage of regulated medical waste before treatment or disposal on-site or transport off-site must comply with the following storage requirements:

  • Must be stored in a manner and location that maintains the integrity of the packaging and provides protection from the elements.
  • Must be maintained in a non-putrescent state, using refrigeration when necessary.
  • Must be stored in a manner that affords protection from animals and does not provide a breeding place or a food source for insects and rodents.
  • All on-site storage of regulated medical waste must be in a designated area away from traffic flow patterns and must be accessible only to authorized personnel.
  • Outdoor storage areas containing regulated medial waste must be locked to prevent unauthorized access.
  • Containment of regulated medical waste must be effected in such a manner that no discharge or release of any waste occurs.
